True Power Premiere Club Retreat Qualifier Agreement Travel Risk And Release
I am a broker (“Broker”) of True Commodities LLC (“True Power”) and have qualified for the True Power Premier Club Retreat (“Retreat”). I have chosen to accept this Retreat voluntarily. I am not required to travel to a foreign country as a condition of my Broker Agreement with True Power. This Travel Risk and Release Form (“Release”) confirms my understanding of and agreement to the following:
Qualifying For True Power Premier Club Broker Retreat.
I understand that I will receive one (1) 3-Day All-Inclusive Basic Package for every 50 new residential customers enrolled by myself or my company. I may earn one (1) additional 3-day package for every additional 50 new residential customers enrolled by myself or my company. Only new residential Texas deregulated area customers may qualify to the extent the new customer is accepted and serviced by True Power. I understand that renewals or any electricity contracts currently with True Power are not applicable to qualify for this Retreat. I also understand that no Power To Choose products or any other products with the same rates at Power To Choose rates qualify for this promotion. All new electricity service contracts must be enrolled with True Power between October 1, 2022 and December 31, 2022 by 5pm CST. All accounts must be active and in good standing by or before 11:59pm CST on January 31, 2023. All new customers must maintain a minimum 12-month electricity agreement term and must be verified in service with True Power with no past due balances. The only expenses borne by True Power include (1) one round trip airfare from Houston to Cancun, (2) transportation to and from hotel and (3) basic 3-day all-inclusive resort package (includes food and beverage of basic 3-day all-inclusive package). Any additional purchases including, but not limited to, food & beverage not included in the basic all-inclusive package, excursions, souvenir, transportation, fines, etc. are expressly excluded and the sole responsibility of the Broker. The retreat dates are not transferable. This promotion is non-transferable, non-refundable, non-replaceable, and non-negotiable. True Power may adjust the dates of the Retreat as True Power deems necessary or due to inclement weather or any event beyond the control of True Power. This promotion is open to individuals who have registered as a broker with the Public Utility Commission. I acknowledge that I am over 21 years old and a United States Resident.
Risks Of International Travel
I understand that participation in the Retreat and international travel involves risks not liable by True Power. These risks can include, without limitation, risks of traveling to, from, and within various international locations; foreign political, legal, medical, social and economic conditions; different standards of design, safety, and maintenance of buildings, public places, and conveyances; and local weather conditions. I understand that my participation in the Retreat exposes me to additional potential risks of illness, injury, and even death. I understand that traveling alone, particularly at night, carries the potential of increased risk to my health, safety, and well-being. I have made my own investigation of these risks, I understand them, and assume them knowingly and willingly.
I also understand that that in working, living, and traveling away from the United States, I may experience increased crime, pollution, high population density, or standards of living and health standards that are different from those to which I am accustomed to. I will take every precaution to safeguard my health and to protect my personal belongings from damage or theft. I understand and accept responsibility for my own welfare during periods of international travel. I further agree that True Power is not responsible for the consequences of my actions, including injury to myself, persons, and property. In the event my actions cause harm to others, I further accept all financial and legal responsibility for any damage, harm, or injury resulting from my actions toward the injured party or to True Power.
I have read and understand the U.S. Department of State Consular Information Sheet about the country or countries to which I am traveling (available on the State Department website at http://travel.state.gov), and I am aware of the risks involved with international travel in general, and with travel to this country in particular. Additionally, prior to leaving, I will register with the U.S. State Department’s Smart Traveler Enrollment Program (STEP) https://step.state.gov/step/, so that I will receive important information from the Embassy about safety conditions in the destination(s).
Health And Safety Concerns.
I understand that I am responsible for obtaining any recommended immunizations before traveling to my destination. I am also aware that, during my participation in the Retreat, I will be responsible for my own health insurance, and I am monetarily responsible for any medical emergencies that may occur while on the Retreat.
I understand and agree that if, during my participation in the Retreat, True Power learns that I am experiencing health problems, have suffered an injury, or am otherwise in a situation that raises health and safety concerns, then True Power may contact the person whose name I have provided as my “emergency contact.” I understand that True Power ordinarily will not initiate such contact without first attempting to have a discussion with me, but that True Power may initiate such contact, without discussing it with me in advance, if True Power believes such action is necessary or appropriate under the circumstances.
Standards Of Conduct,
I recognize that I assume an important personal obligation to conduct myself in a manner compatible with local laws and regulations and with the policies of the hotel institution, organization, or company. I promise to act responsibly and will become informed of, and will abide by, all such laws, regulations, policies, and standards. I understand that my failure to abide by applicable laws, regulations, rules, and policies may result in law enforcement action against me by local laws and regulations.
Travel Arrangements.
In consideration for my participation in the Retreat, I hereby agree for myself, my heirs, and assigns, to release, discharge, indemnify, and hold harmless True Power, and its officers, agents, employees, and representatives, from any and all liability, claims, demands, injuries, damages, costs, (“claims”) resulting from, related to, or arising as a result of my participation in the Retreat, including, but not limited to claims for: (i) any act or default committed by True Power or anyone hired by True Power to arrange or conduct events; (ii) any injury, loss, damage, accident, delay, or expense resulting from the use of any vehicle, strike, war, weather, sickness, quarantine, government restriction or regulation; (iii) any act or omission by any steamship, airline, railroad, bus, taxi service, hotel, restaurant, or university; or (iv) any other financial obligation or liability, or damage or injury to me or my property. I further accept and assume any and all risk of trip cancellation by True Power, the United States Department of State, and/or by the government of any host country
Elective Participation.
During the course of the Retreat, True Power may take photographs of me to be used for marketing or publicity purposes. I hereby authorize True Power, its official representatives, employees, or agents, to use photos or videos of me for any and all publicity, publications, and advertising purposes that True Power may designate. I further understand and agree that if I provide a quote or a statement for use in Retreat publicity, that True Power may use any such statements or quotations for that purpose.
General Release.
In further consideration for my participation in the Retreat , I assume all the risks and responsibilities associated with my participation in the Retreat, and in return for the services provided to me by True Power associated with the Retreat, I hereby agree on behalf of myself, my heirs, and assigns, to release, discharge, indemnify, and hold harmless True Power, and its officers, agents, employees, and representatives, from any and all liability, claims, demands, and actions that may arise from physical or financial injury or harm to me, from my death, or from damage to my property in connection with, resulting from, related to, or arising as a result of my participation in the Retreat. I understand that this release covers liability, claims, demands, and actions, including but not limited to negligence, mistake, or failure to supervise, caused entirely or in part by any act or failure to act of True Power, its officers, agents, employees, and representatives.
I certify that I am age 21 or older. I have carefully read this Agreement. I understand and agree that it is the entire agreement, that it may not be modified except in writing signed by True Power and me, and it is binding on me, my heirs, personal representatives, successors, and assigns. Any legal action regarding this Agreement must be filed in the State of Texas, and Texas law shall apply.
